MATCHA Paris - GENERAL CONDITIONS OF SALE

1 - PREAMBLE
These General Conditions of Sale govern the relations between MATCHA–PARIS –AS Peyre, located at 106 Avenue Ferdinand de Lesseps, 34110 Frontignan, registered under SIRET number 539 223 586 00014 and any natural or legal person hereinafter referred to as "the buyer" wishing to make a purchase on the website www.matchaparis.com

2- OBJECT
These terms of sale aim to define the contractual relations between MATCHA-Paris and the buyer and the conditions applicable to any purchase made through the MATCHA-Paris merchant site, whether the buyer is a professional or a consumer. The acquisition of a good or a service through this site implies unreserved acceptance by the buyer of these terms of sale. These terms of sale will prevail over any other general or specific conditions not expressly agreed to by MATCHA-Paris.
MATCHA-Paris reserves the right to modify its general conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the products offered
The products offered are those listed on the MATCHA-Paris website. These products are offered while stocks last.
Each product is accompanied by a description and photographs that are as accurate as possible. The visualization on the site and the configuration of the computer workstations do not always ensure perfect similarity with the product offered.
Rates
Prices are indicated in euros including VAT. The applicable VAT rate is the rate in effect on the day of the order. However, MATCHA-Paris reserves the right to pass on to the Buyer any change in the VAT rate applicable to the order. The seller reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the price indicated when the order was registered. The prices indicated do not include transport and shipping costs.
3 - ORDERING METHOD:
The Buyer who wishes to purchase a product must:
* Follow the order process, including acceptance of these general terms and conditions of sale
* Complete the identification form on which he will indicate all the requested contact details
* Choose the items he adds to the cart
* Validate the contents of the basket
* Make payment under the conditions provided
- Validate your order and payment.
The buyer will receive an order confirmation email.
All data provided and the recorded confirmation will constitute proof of the transaction, the email confirming the recorded order will constitute signature and acceptance of the operations carried out.
4 - PAYMENT TERMS
Any order will only be taken into consideration after acceptance of payment.
The price is payable upon ordering.
Payments will be made through a PAYPAL account or by credit card. In this case, they will be made through the secure system that uses the Stripe protocol secure web payment infrastructure (certified PCI level 1, the highest level of security) so that the information transmitted is encrypted by software and no third party can read it during transport on the network. The buyer's account will only be debited when the available products are shipped and only for the amount of the products sent.
5 - DELIVERIES
The risks are the responsibility of the Buyer from the moment the products leave the premises of MATCHA-Paris. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery. Delivery times are given as an indication. These times are those displayed by the various carriers (La Poste, etc.). Orders are sent by letter or tracked parcel, which allows us to track your parcel if it does not reach you. The buyer is delivered to his home by his postman. In the event of the buyer's absence, he will receive a notice of passage from his postman, which allows him to collect the products ordered from the nearest post office, during a period indicated by the postal services. The buyer is required to check in the presence of the post office employee or delivery person, the condition of the packaging of the goods and its contents upon delivery.
These deadlines may be affected by strikes, export problems, customs changes and other external problems for which we cannot be held responsible, or by any other technical problems beyond our control.
Any reasonable delay in the delivery of the products may not give rise to the award of damages or cancellation of the order for the benefit of the buyer.
The Buyer is required to check the good condition of the delivered items. Any anomaly noted (missing item, damaged package, broken item, etc.) must be reported within 4 days of receipt.
6- RIGHT OF WITHDRAWAL
The buyer has a right of withdrawal within 14 days. The withdrawal period expires 14 days after the day on which the Buyer, or a third party other than the carrier and designated by the Buyer, takes physical possession of the items. If the end of the period ends on a weekend or a public holiday, the period is extended until the next working day. During this period, the buyer may, at his own expense, return a product that does not suit him.
Return costs are the responsibility of the Buyer.
The return of the product(s) must be made within 14 days of sending the withdrawal. Any return must be reported in advance and validated with MATCHA Paris by sending an email to our email address contact@matchaparis.com specifying your order number. The product must be returned by tracked mail, such as a tracked letter, to the following address: MATCHA Paris,

Only products returned in their entirety, in their original packaging, complete and intact, and in perfect condition for resale will be accepted. Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.
In the event of exercising the right of withdrawal, the Buyer has the choice of requesting either a refund of the sums paid or an exchange of the product. In the case of an exchange, re-shipping will be at the Buyer's expense. In the event of a refund request, payments for the product(s) purchased from MATCHA-Paris will be refunded to the Buyer within 14 days.

During the sales period and during exceptional promotions or clearance sales, items sold are neither returned nor exchanged.
7 - RESPONSIBILITY
MATCHA Paris in the online sales process, is only bound by an obligation of means; its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
8 – INTELLECTUAL PROPERTY
MATCHA Paris is a registered trademark with the INPI. The models, jewelry accessories, designs, photos, objects and images offered by the site www.matchaparis.com are the property of MATCHA Paris and are protected by intellectual property law, in particular governed by international copyright law. The buyer acknowledges that the use he can make of the products ordered is limited to use in accordance with their intended purpose. Any other use of the models, designs, logos, photos, objects and images, such as reproduction, reproduction of the site (even partial), marketing, distribution and publication by anyone is strictly prohibited and constitutes an infringement that may be punished criminally and civilly.
9- SETTLEMENT OF DISPUTES
These online sales conditions are subject to French law. For all disputes or litigation, the competent court will be that of Paris.
